Terms of use and sale

These terms govern the use of the La Route Buissonnière app and website, as well as subscription to the Pro offer. By using the app, you accept them. They are completed by our legal notice and our privacy policy.

1. Publisher

The app is published by Audrey Morin, sole trader (micro-entreprise), trading under the name Base Lunaire. Full details in the legal notice.

2. Description of the service

La Route Buissonnière is a road navigation aid that suggests routes favouring enjoyment (villages, countryside, back roads) rather than speed alone. It comprises a free version and a paid Pro offer unlocking advanced features (avoiding several cities, points of interest, green route, round trips, offline downloads, and so on).

3. Access

The app can be used without creating an account. You are responsible for having a compatible device and an internet connection (except for offline use previously downloaded).

4. The Pro subscription

The Pro offer is available in several forms:

• Monthly — automatically renewed each month;
• Annual — automatically renewed each year;
• Lifetime — a single payment, with no renewal.

The applicable prices, inclusive of all taxes, are shown in the app at the time of subscription. They may change; the price that applies is the one displayed at the time of purchase. For automatically renewing plans, renewal is billed automatically unless cancelled before the due date.

5. Payment

Purchases made within the app (Android): these are processed by Google Play. For users in the European Union, Google acts as the seller and is responsible for invoicing, collecting and remitting VAT. These purchases are also subject to the Google Play terms of service. Managing your subscription (renewal, cancellation, payment method) is done from your Google Play account.

Purchases made on the website (for example the "lifetime" option): these are sold directly by the publisher and processed through the secure payment provider Stripe. Prices are shown inclusive of all taxes (French VAT applicable).

6. Right of withdrawal

The Pro offer is digital content supplied immediately after purchase. In accordance with article L.221-28 of the French Consumer Code, by requesting immediate access to the service you acknowledge that you expressly waive your 14-day right of withdrawal once access to the digital content has been opened.

For purchases made through Google Play, the Google Play refund policy applies.

7. Cancellation

You may cancel an automatically renewing subscription at any time, free of charge, from the "Subscriptions" section of your Google Play account. Cancellation takes effect at the end of the current period: you keep Pro access until that date, with no further payment taken.

8. Road safety — important

La Route Buissonnière is a navigation aid, not a substitute for your own attention. In using it, you undertake to:

• comply at all times with the highway code and road signs;
• not handle the app while driving, and remain fully in control of your vehicle;
• not follow any instruction that would be dangerous, prohibited or unsuitable for your vehicle.

Routes, times and points of interest are provided for guidance only, based on third-party data (notably OpenStreetMap) which may contain errors or be imperfectly up to date. The publisher cannot be held liable for damage resulting from use of the app, within the limits permitted by law.

9. Availability of the service

The publisher takes reasonable steps to keep the app available, without guaranteeing continuous or uninterrupted operation. The service depends on third-party providers (base maps, geocoding, route calculation) whose unavailability may affect it.

10. Intellectual property

The trade mark, the logo, the content and the code of the app are protected. Map data is provided by OpenStreetMap and its contributors (ODbL licence). See the legal notice.

11. Personal data

The processing of your data is described in our privacy policy.

12. Consumer mediation

In accordance with the French Consumer Code, in the event of a dispute that cannot be settled amicably, consumers may refer the matter free of charge to a consumer mediator: [consumer mediator to be appointed before direct sales]. A European online dispute resolution platform is also available: ec.europa.eu/consumers/odr.

13. Governing law

These terms are governed by French law. Failing an amicable settlement, the French courts have jurisdiction, subject to the protective rules applicable to consumers.
